GST Instructions - Illegal mining and mineral transportation information will now be systematically shared with GST authorities to identify possible tax evasion and initiate action under the CGST law [Instruction attached]

The government has issued an order to enhance coordination between State Mining Authorities and GST authorities to curb tax evasion related to illegal mining and mineral transportation. State Mining Authorities frequently uncover illegal activities such as unauthorized mining, mineral transportation, and other violations, which may indicate non-compliance with GST regulations. The shared information can reveal issues like suppression of taxable supplies, non-registration, undervaluation, and improper input tax credit claims under the CGST Act, 2017.
To facilitate this process, each CGST Zone is required to appoint a Nodal Officer to liaise with State Mining Departments, ensuring a streamlined exchange of relevant information. A systematic mechanism must be established for the regular sharing of data on illegal mining activities. This information will be scrutinized to identify any GST-related violations, prompting necessary actions under the CGST Act, 2017 and its rules.
Upon identifying potential GST implications, the intelligence will be distributed to jurisdictional Commissionerates and DGGI formations for further action. Regular meetings with State Mining Authorities will be conducted to evaluate the system's effectiveness and address any operational challenges. This initiative aims to ensure that critical intelligence regarding illegal mining is effectively utilized to prevent GST evasion.

- State Mining Authorities regularly detect illegal mining, illegal transportation, seizure of minerals and vehicles, cancellation or suspension of mining leases, excess extraction and other violations. These instances may also point towards GST non-compliance.
- Such mining-related information can indicate suppression of taxable supplies, non-registration, undervaluation, non-payment or short payment of GST, wrongful availment of input tax credit and other forms of GST evasion. The instruction aims to ensure that this intelligence is not overlooked.
- Every CGST Zone must designate a Nodal Officer to coordinate with the respective State Mining Department. This creates a defined point of contact for collecting and sharing relevant mining-related information.
- CGST Zones are required to establish a mechanism with State Mining Authorities for the periodic sharing of information relating to illegal mining and transportation of minerals detected within their jurisdiction. This information will then be examined from a GST perspective.
- Once received, the information must be suitably analysed to identify potential GST implications. Wherever violations are found, appropriate action is to be initiated under the CGST Act, 2017 and the rules made thereunder.
